Scope of Application<\/strong><\/p>\n<p>1.1<br \/>\nThe following general terms and conditions apply to contracts for the rental of guesthouse rooms for accommodation and conferences, as well as all other services and deliveries provided by the guesthouse for the guest.<\/p>\n<p>1.2<br \/>\nDeviating regulations are only valid if they have been individually agreed upon between the Inn and the guest.<\/p>\n<p><strong><br \/>\n2. Conclusion of the Contract<\/strong><\/p>\n<p>2.1<br \/>\nThe accommodation contract is concluded when the guest submits an application (room booking), which is accepted by the Inn. Acceptance is confirmed by a room booking confirmation. If the room booking is made in writing, which also includes bookings via email, fax, electronic booking form, or an online booking platform, the application is only considered accepted with our written confirmation (also via email or fax).  <\/p>\n<p>2.2<br \/>\nIf the room booking is made by a third party for the guest, that third party is liable to the Inn jointly and severally with the guest for all obligations arising from the hotel acceptance contract, provided that the Inn has received a corresponding declaration from the third party.<\/p>\n<p>2.3<br \/>\nThe subletting and re-letting of the rented rooms, as well as their use for purposes other than accommodation, require the prior written consent of the Inn.<\/p>\n<p><strong><br \/>\n3. Prices and Services<\/strong><\/p>\n<p>3.1<br \/>\nThe Inn is obliged to keep the rooms booked by the guest available in accordance with these General Terms and Conditions and to provide the agreed services.<\/p>\n<p>3.2<br \/>\nThe guest is obliged to pay the applicable or agreed prices of the Inn for the room rental and the other services used by them. This also applies to services and expenses of the Inn towards third parties initiated by the guest or the booker. <\/p>\n<p>3.3<br \/>\nThe agreed prices include the statutory value-added tax applicable to the individual services on the day of invoicing.<\/p>\n<p>3.4<br \/>\nPrices may be changed by the Inn if the guest subsequently requests changes to the number of booked rooms, the Inn&#8217;s services, or the duration of the guests&#8217; stay, and the Inn agrees to this.<\/p>\n<p>3.5<br \/>\nFor bookings made 6 months or more before the desired arrival date, we ask for your understanding that the respective prices for the individual services are strictly non-binding and can be adjusted by the Inn according to its requirements.<\/p>\n<p>3.6<br \/>\nInvoices from the Inn are payable immediately upon receipt or handover without deduction. Payment methods are generally cash, Girocard, or credit card. Billing is in Euros; foreign currencies are not accepted by the Inn.  <\/p>\n<p>Other payment methods or types of payment are only possible with the prior consent of the Inn.<\/p>\n<p>Default occurs if the guest does not make payment within 7 days of the due date and receipt or handover of an invoice; this applies to a guest who is a consumer only if these consequences have been specifically pointed out in the invoice. In the event of payment default, the Inn is entitled to charge default interest to consumers at a rate of 5% above the base interest rate. In commercial transactions, the default interest rate is 9% above the base interest rate. The Inn reserves the right to claim higher damages. For each reminder after default, the Inn may charge a reminder fee of EUR 2.00.    <\/p>\n<p>3.7<br \/>\nThe Inn is entitled to demand a reasonable advance payment or security deposit upon conclusion of the contract or thereafter. The amount of the advance payment and its due date can be agreed upon in writing in the contract. The Inn is also entitled to make accrued claims during the guest&#8217;s stay at the hotel due at any time by issuing an interim invoice and to demand immediate payment.  <\/p>\n<p>3.8<br \/>\nThe guest can only offset or reduce a claim of the hotel with an undisputed or legally established claim.<\/p>\n<p><strong>4. Unused Services, Cancellation, Guest&#8217;s Withdrawal<\/strong><\/p>\n<p>4.1<br \/>\nThe Inn grants the guest a right of withdrawal at any time. The following provisions apply depending on the time of cancellation or<br \/>\nwithdrawal or non-utilization of the contractually agreed services by the guest: <\/p>\n<p>&#8211; If, despite a valid contract, there is no arrival, the Inn is entitled to compensation in the full amount of all contractually agreed services.<br \/>\n&#8211; Free cancellation\/free contract withdrawal is possible up to 8 days before the arrival date.<br \/>\n&#8211; If a cancellation\/contract withdrawal occurs on the arrival date or up to 7 days before the arrival date, the Inn is entitled to compensation in the full amount of the contractually agreed overnight stay service.<\/p>\n<p>4.2<br \/>\nThe right to compensation lapses if the Inn has granted the guest an option in the contract to withdraw from the contract within a certain period without further legal consequences; in this case, the Inn has no right to compensation. The timeliness of the withdrawal declaration is determined by its receipt by the hotel. The guest must declare the withdrawal in text form.  <\/p>\n<p><strong>5. Withdrawal by the Inn<\/strong><\/p>\n<p>5.1<br \/>\nIf the guest has been granted a free right of withdrawal under section 4.2 in the accommodation contract, the Inn is also entitled to withdraw from the contract within the agreed period if there are inquiries from other guests for the booked rooms.<\/p>\n<p>5.2<br \/>\nIf an advance payment or security deposit agreed upon in accordance with section 3.7 is not made within a set deadline, the Inn is likewise entitled to withdraw from the contract.<\/p>\n<p>5.3<br \/>\nThe right to withdraw from the contract for good cause remains unaffected. This applies in particular if: <\/p>\n<p>\u2013 force majeure or other circumstances for which the inn is not responsible make the fulfillment of the contract impossible;<br \/>\n\u2013 rooms are booked under misleading or false statements of essential facts, e.g., regarding the person of the guest or the purpose;<br \/>\n\u2013 the inn has reasonable grounds to believe that the use of the service may jeopardize the smooth business operation, the security, or the reputation of the inn in public, without this being attributable to the inn&#8217;s sphere of control or organization;<br \/>\n\u2013 unauthorized subletting or re-letting exists according to clause 2.3;<br \/>\n\u2013 there is a non-contractual use of the rented room, which includes, for example, a violation of the non-smoking policy, vandalism, causing dirt or contamination that exceeds the normal extent of usual use of the guesthouse room.<br \/>\n\u2013 a case of clause 6.3 exists;<br \/>\n\u2013 the inn becomes aware of circumstances indicating that the guest&#8217;s financial situation has significantly deteriorated after the conclusion of the contract, especially if the guest does not settle due claims of the inn or does not provide sufficient security, and therefore the inn&#8217;s payment claims appear to be at risk;<br \/>\n\u2013 the guest has filed an application for the opening of insolvency proceedings over their assets, provided a declaration of assets according to \u00a7 807 of the Code of Civil Procedure, initiated an out-of-court procedure for debt settlement, or ceased payments;<br \/>\n\u2013 insolvency proceedings are opened over the guest&#8217;s assets or the opening thereof is refused due to insufficient assets or for other reasons. <\/p>\n<p>5.4<br \/>\nThe Inn will immediately inform the guest in text form of the exercise of the right of withdrawal.<\/p>\n<p>5.5<br \/>\nIn the aforementioned cases of withdrawal, the guest has no claim for damages.<\/p>\n<p><strong>6. Arrival and Departure\/Parking Facilities<\/strong><\/p>\n<p>6.1<br \/>\nThe guest generally does not acquire a right to the provision of specific rooms, unless the Inn has confirmed the provision of specific rooms in writing.<\/p>\n<p>6.2<br \/>\nBooked rooms are available to the guest from approximately 2:00 PM on the agreed arrival day. The guest has no right to earlier provision. <\/p>\n<p>6.3<br \/>\nBooked rooms must be occupied by the guest no later than 6:00 PM on the agreed arrival day. Unless a later arrival time has been expressly agreed upon, the Inn has the right to reassign booked rooms after 6:00 PM without the guest being able to derive any claims for compensation therefrom. The Inn is entitled to a right of withdrawal in this respect.  <\/p>\n<p>6.4<br \/>\nOn the agreed departure day, the rooms must be vacated and made available to the Inn by 11:00 AM at the latest. Thereafter, the Inn may charge the full daily room rate for additional use of the room until 2:00 PM or beyond, in addition to any damages incurred. The guest is free to prove to the hotel that no or significantly lower damage has been incurred.  <\/p>\n<p>6.5<br \/>\nGuests have the option to park their vehicle free of charge in the &#8220;Sch\u00fctzenplan&#8221; parking lot, which is directly adjacent to our property.<br \/>\nThe open areas within our property are reserved exclusively for staff and day guests visiting our restaurant or events in our ballroom.<\/p>\n<p><strong>7. Liability of the Inn<\/strong><\/p>\n<p>7.1<br \/>\nThe Inn is liable in cases of intent or gross negligence in accordance with statutory provisions. For slight negligence, the Inn is liable exclusively for injury to life, body, or health or for the breach of essential contractual obligations. The Inn is liable for items brought in by the guest in accordance with the applicable statutory provisions. The Inn assumes no liability for valuables, cash, or credit or similar cards; the introduction of the aforementioned items is solely at the guest&#8217;s own risk and peril. However, the claim for damages for the slightly negligent breach of essential contractual obligations is limited to the foreseeable damage typical for the contract, unless liability is incurred for injury to life, body, or health. The Inn is liable for the fault of its vicarious agents and representatives to the same extent.     <\/p>\n<p>7.2<br \/>\nThe provision of the preceding paragraph (7.1) extends to damages in addition to performance, damages instead of performance, and claims for reimbursement of futile expenses, regardless of the legal reason, including liability for defects, delay, or impossibility.<\/p>\n<p>7.3<br \/>\nThe guest has no right to use the parking facilities located on the Inn&#8217;s property. These are reserved exclusively for staff and guests of our hall and restaurant operations. Guests of the guesthouse have the option to park in the &#8220;Sch\u00fctzenplan&#8221; parking lot, which is located directly behind the Inn&#8217;s property. If the guest nevertheless parks on areas belonging to the Inn&#8217;s property, this is done at their own risk and peril.   <\/p>\n<p>7.4<br \/>\nWake-up calls are not provided by the Inn.<\/p>\n<p>7.5<br \/>\nMessages, mail, and consignments for guests are handled with care. The Inn undertakes delivery, storage, and \u2013 upon request \u2013 forwarding of the same for a fee, as well as for lost property upon request. Claims for damages, except for gross negligence or intent, are<br \/>\nexcluded. The Inn is entitled, after a maximum storage period of one month, to hand over the aforementioned items to the local lost and found office, charging a reasonable fee.   <\/p>\n<p>7.6<br \/>\nThe limitation period for the guest&#8217;s claims is governed by statutory provisions.<\/p>\n<p><strong>8. Guest&#8217;s Liability <\/strong><\/p>\n<p>8.1<br \/>\nIf the guest loses their key card or hands it over to a third party, the guest alone is liable for its loss and\/or any possible misuse of the key card by third parties. This particularly concerns resulting thefts and property damage affecting the property\/possession of the guest themselves, other guests, the Inn, or employees of the Inn. <\/p>\n<p>8.2<br \/>\nFor damages in the room\/to the building caused intentionally or unintentionally by the guest, the guest (possibly their liability insurance) is fully liable. The same applies to animals brought by the guest. <\/p>\n<p>8.3<br \/>\nFor damages to furnishings in the room\/in the building caused intentionally or unintentionally by the guest, the guest (possibly their liability insurance) is fully liable. The same applies to animals brought by the guest. <\/p>\n<p>8.4<br \/>\nIf the guest or their animal causes dirt and contamination in the room, on the building, or on furnishings that exceed the normal extent of usual use of a guesthouse room, the Inn operator will have these dirt and contamination removed at the guest&#8217;s expense.<\/p>\n<p>8.5.<br \/>\nSystems that serve the safety of guests and the Inn (electronic locks, mechanical locks, fire alarms, sirens, fire extinguishers, network devices, etc.) may not be impaired in their function, damaged, destroyed, dismantled, altered, or misused by the guest. If such an action nevertheless occurs, the guest is liable for all resulting property damage and\/or personal injury. <\/p>\n<p>8.6<br \/>\nThe guest is informed that we only rent non-smoking rooms. If the guest nevertheless smokes in the room (this also includes smoking at the window), this constitutes non-contractual behavior by the guest. The Inn has the right to terminate the accommodation contract immediately. The Inn will charge the costs incurred for restoring the room to a non-smoking room.   <\/p>\n<p><strong>9. Final Provisions &#8211; Severability Clause<\/strong><\/p>\n<p>9.1<br \/>\nThe law of the Federal Republic of Germany applies.<\/p>\n<p>9.2<br \/>\nShould individual provisions of this contract be or become invalid or unenforceable after the conclusion of the contract, the validity of the remainder of the contract shall remain unaffected.
